Overview

This End User License Agreement (“Agreement”) is between you (“User”) and Zenzephyr Ltd (“Company”). By downloading or using our application “ZENZEPHYR” (“App”), you agree to be bound by this Agreement. If you do not agree with these terms, do not download or use the App.

Promotional Access

For a limited time, ZenZephyr may offer users complimentary access to all features of the platform (“Promotional Access”). The duration of this promotional period will be determined solely at ZenZephyr’s discretion and may vary without notice.

● Purpose of Promotional Access: Promotional Access is provided to allow users to explore and experience the full functionality of the platform. Users acknowledge that this access is granted as a limited-time offer and may not be available indefinitely.

● Modification, Extension, or Termination: ZenZephyr reserves the right to modify, extend, or terminate the promotional period at any time, without prior notice. ZenZephyr is not obligated to extend the promotional period beyond the initial offering.

● Post-Promotional Access: Upon the conclusion of the promotional period, users may be required to subscribe to a paid plan in order to continue accessing certain features of the platform. Specific details regarding paid subscription options and pricing can be found in our Subscription Plans section.

● Changes to Subscription Plans: ZenZephyr may adjust the terms, pricing, or structure of its subscription plans at any time after the end of the promotional period. Continued access to premium features after the promotional period will be subject to the terms outlined in the subscription plans.

Subscription Terms

Subscription Overview

 By subscribing to our monthly service, you will gain access to intermediate or premium features of the App.

Subscription Length and Price

● Length: Monthly (Auto-renewal)

Subscription Benefits

● Intermediate Subscription: Users can show interest in up to 100 profiles daily, communicate via text, emoticons, or voice notes, modify location filters, and view matches within a 100 km radius. The app will be ad-free for subscribed users.

● Premium Subscription: Users can show interest in an unlimited number of profiles daily, view who has viewed their profile, adjust location filters, and access matches within a 150 km radius. The app will be ad-free for subscribed users.

Auto-Renewal

 Your subscription will automatically renew each month at the specified price unless you cancel it. Renewal occurs on the same day each month as the initial subscription date.

Payment and Cancellation

● Payment: Charges will be applied to your Apple ID account upon confirmation of purchase.

● Cancellation: You may cancel your subscription at any time through your Apple ID account settings.

Refunds

 Subscription fees are non-refundable.

Changes to Terms

 We reserve the right to modify these terms at any time. Any changes will be communicated to you in advance, and you will have the opportunity to cancel your subscription if you do not agree to the new terms.

Privacy

 Your use of the App is also governed by our Privacy Policy, which is incorporated into this Agreement by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

By using the App and subscribing to premium features, you acknowledge that you have read, understood, and agree to be bound by this Agreement.

1. AGREEMENT TO TERMS

These Terms and Conditions constitute a legally binding agreement between you (“User” or “You”) and Zenzephyr Ltd (“Company,” “We,” or “Our”) regarding your use of the ZENZEPHYR Dating Application (“App”). By using the App, you agree to abide by these Terms. If you do not agree, you must immediately stop using the App.

We reserve the right to modify these Terms at any time. It is your responsibility to review these Terms periodically. Continuing to use the App after any updates constitutes your acceptance of the revised Terms.

2. CHANGES TO TERMS

We may update these Terms from time to time. The most current version will be posted on the App. If we make significant changes, we will notify you via email or a notice on the App. Continued use after changes are made constitutes acceptance of the updated Terms.

3. TRANSLATION

The English version of these Terms governs your relationship with the App. If translated versions are available, they are for convenience only. In case of discrepancies, the English version will prevail.

4. CONTENT ON THE SERVICES

You are responsible for your use of the services and any content you provide. You should only share content that you are comfortable with others viewing. We do not guarantee the accuracy or reliability of content posted by users.

We may remove content that violates these Terms, including any intellectual property infringements, unlawful conduct, or harassment.

5. INTELLECTUAL PROPERTY RIGHTS

All content, including source code, software, design, and trademarks, is the proprietary property of Zenzephyr Ltd and is protected by intellectual property laws. You may not use or exploit any part of the App for commercial purposes without our written permission.

6. USER REPRESENTATIONS

By using the App, you represent and warrant that:

● All registration information is true and accurate.

● You will comply with these Terms and applicable laws.

● You will not use automated means to access the App.

● You will not engage in any unlawful or unauthorized activities.

7. USER REGISTRATION

You may be required to create an account. Keep your password secure and update it as needed. We may remove or change your username if it is deemed inappropriate.

8. REPRESENTATIONS AND WARRANTIES

We are not obligated to enforce these Terms against other users. We encourage you to report any violations, but we reserve the right to investigate and take action at our discretion.

9. INDEMNITY

You agree to indemnify Zenzephyr Ltd and its affiliates from any claims arising out of your use of the App or violations of these Terms.

10. YOUR RIGHTS IN CONTENT

You retain ownership of your content. However, by submitting content to the App, you grant us a license to use, display, and distribute it globally without compensation.

11. THIRD PARTIES

We are not responsible for third-party actions or communications. If you wish to stop receiving communications from third parties, you must contact them directly.

12. USING THE SERVICES

You may use the services only in compliance with these Terms. We reserve the right to modify, suspend, or terminate the services at our discretion.

13. YOUR ACCOUNT

You are responsible for safeguarding your account. We are not liable for any loss or damage arising from your failure to secure your account.

14. LICENSE TO USE THE SERVICES

Zenzephyr Ltd grants you a personal, non-transferable, and non-exclusive license to use the App for its intended purpose, subject to these Terms.

15. ENDING THESE TERMS

You can terminate your agreement with us by deactivating your account and ceasing to use the App.

16. DISCLAIMERS AND LIMITATIONS OF LIABILITY

Zenzephyr Ltd’s liability is limited to the maximum extent permitted by law. We are not liable for any damages arising from your use or inability to use the App.
